Shoot Process
Not sure how my shoot process works? Read these steps to see how, from first contact to getting your final edited images from me:
Initial Consultation & Planning
The first step is understanding your requirements. This is where we discuss your ideas, budget, dates, and any other requirements needed for me to get a good understanding of your desired final product.
If you have any reference images to aid with this, such as the subject(s) to photograph, the location(s) to shoot at, the images you saw that inspired your idea, or anything else that would help convey your ideas, this would be a great time to have them handy!
Once we've worked out these details, I will send an invoice containing the following items:
- The non-refundable retainer fee. This is 50% of the total shoot cost (not including any travel fees), and will secure my services with you on the given date, as well as pay for any consultation/planning done with you.
- The remainder of the shoot cost. This is the other 50% of the total shoot cost (not including any travel fees).
- Any travel expenses, if applicable. This will cover the cost of my travel to and from the planned shoot location(s).
- Any other agreed items.
This invoice will need to be paid within 7 days of being sent to you.
Your shoot won't be considered booked and secured until this is paid!
Shoot Day
Assuming the weather is on our side for the day, we will meet up at our first planned location, have a chat & review of our plan together, and then get down to shooting!
There is no rush for you to get into suit; unless otherwise agreed, I've booked out the entire day for you, the day is yours!
Image Review & Delivery
After the shoot is finished, I will send you proof images from the shoot within 1-2 weeks. When you get these, you are free to pick up to the agreed amount of images you want delivered, and provide me this list of chosen images to work on.
Once I have your final list of chosen images, I will get to work on finishing those images, within 4-8 weeks. When they're ready, I will send those as a .zip file to the agreed file sharing location for you!
Once you receive your final images from me, make sure to save them to a safe location, and consider saving an extra copy to a separate physical device/location!
Pricing
As every shoot has different requirements, the total price will likely vary. However, the final price generally consists of the following:
Base Price
This starts at £80.
This price covers booking me for your shoot, my time to consult your requirements, and my time to edit and deliver 10 images of your choice from the shoot.
Because my pricing is based on the number of images delivered per day, not by the hour, this price is the same if your shoot is 1 hour long, or 3 hours long.
Additional Images
As my prices are based on the number of images delivered per day, there is an additional cost for adding more images to the deliverables. These come as extra sets of 5 images, and you get a slight per-image discount with more:
- 05 extra images (15 in total) - £35
- 10 extra images (20 in total) - £67.50
Additional image sets pricing on request.
Travel Expenses
If I need to travel to get to your shoot location(s), this will be added on in a separate invoice (before those travel costs have been expensed). This could include items such as car fuel & parking, train tickets, etc.
Venue/Ticket Expenses
If there are expenses associated with shooting at your desired location(s), such as entry ticket fees, hire fees, or permit fees to shoot in the space, I will ask you to pay for my entrance ticket/hire/permit.
Terms of Service
When booking a session with me, you agree to these terms of service upon paying your invoice.
1. Definitions
- Photographer - bwuff
- Client - You, including your principals, employees, affiliates and representatives
- Image(s) - The photographic material, still or moving, created by the Photographer to meet the terms of this service. This includes, but is not limited to, digital files, film positives, film negatives or prints that were captured, recorded, stored, or delivered on any type of medium.
This agreement is between the Photographer and Client. The Client agrees that it has the legal authority to enter into this agreement on behalf of its employer, company or organisation.
These Terms of Service are governed by the laws of England and Wales.
2. Scope of Work
- The Photographer agrees to provide photography services at the agreed upon location(s) for the Client, in consideration of payment following the terms of this service contract/Terms & Conditions.
- The Photographer agrees to engage in a pre-shoot consultation with the Client, in which the Client shall assist the Photographer in specifying subject(s) and/or scene(s) to be photographed, and any other details relevant to the shoot. The Photographer is not liable for any images not produced as a result of the Client's failure to specify them during this consultation.
-
The Photographer may refuse to provide photography services to the Client,
if the subject(s) and/or scene(s) to be photographed include any of,
but not limited to, the following:
- Hate speech - Expressing hate or encouraging violence towards a person or group or people.
- Nudity - Partial or Full.
- At the shoot, the Client shall assist and cooperate with the Photographer to obtain the desired images, including, but not limited to posing for images at the Photographer's direction. The Photographer is not liable for any images not produced as a result of the Client's failure to provide reasonable co-operation or assistance.
- The Photographer shall deliver proof image(s) within 2 weeks after the end date of the shoot. The Client understands that these image(s) are not the final product, and remain the exclusive property of the Photographer.
- The Client shall receive no fewer than the agreed on number of proof images, and understands the Photographer is not liable to provide every image taken. The selection of proof images shown to the Client is left to the discretion of the Photographer.
- The final delivered image(s) shall receive editing at the discretion of the Photographer, including, but not limited to: adjustments to colour, crop, exposure and contrast.
- The Photographer shall deliver the final image(s) within 4 to 8 weeks after the Client has selected their desired image(s) from the delivered proofs. These will be delivered as a .zip file sent via Telegram, or other agreed upon file-sharing service.
3. Fees and Payment
- All fees and payment amounts are given as Pound Sterling (GBP), and are to be paid via PayPal, unless otherwise agreed upon.
-
The Photographer will send out an invoice to the Client at the time of booking, payable by the Client to the Photographer.
- This invoice must be fully paid and the payment cleared within seven (7) days of issue.
- No payment plans will be accepted. The full balance must be paid in one (1) payment.
- Once the full payment is received and cleared, the Photographer will secure the agreed shoot time and date.
- In the event this invoice is not fully cleared within seven (7) days of issue, the Photographer will consider the shoot to be cancelled by the Client, and be subject to the Client cancellation terms.
-
The items on the invoice may include, but are not limited to, the following items:
- A non-refundable retainer fee of 50% of the total shoot cost - This is required to secure the agreed shoot time and date, pay for any consulting/planning, and serves as liquidated damages in the event of Client cancellation or Client breach of contract. This fee is credited towards the total amount quoted.
- The remaining 50% of the total shoot cost.
- Any travel expenses, if required, in order to carry out the shoot.
-
As soon as the booking(s)/expense(s) for travel are made, these costs are expensed, and as such are non-refundable.
- In the event of Client cancellation or Client breach of contract after booking(s)/expense(s) for travel are made, these non-refundable travel costs will be converted to liquidated damages.
4. Refunds
-
No refunds will be given to the Client if any one of the following apply:
- The Client fails to attend on the agreed time and date of the shoot, regardless of the circumstances.
- The Client "doesn't like the image(s)", be that during the shoot or upon receiving the proofs or final delivered image(s).
- The final image(s) have been sent to the Client. Due to the nature of images, once they have been sent, they cannot be returned with proof that they haven't been duplicated elsewhere. Because of this, the transaction between Photographer and Client is considered complete upon sending the final image(s).
-
In the unlikely event that image(s) and/or equipment are lost, stolen,
damaged, destroyed, or subject to a photographic or mechanical failure, and only
when no image(s) can be delivered to the Client because of this, the
Client will be entitled to a full refund of the shoot fees, including
any non-refundable retainer fees.
- Any already expensed and non-refundable travel expense fees will remain non-refundable.
5. Rescheduling and Cancelling
Rescheduling
-
If the Client wishes to reschedule before or on their shoot start time
and date, one of the following will happen, depending on the notice given,
whether the shoot is their original or rescheduled one, and if travel
has already been expensed:
- Rescheduling with more than or equal to fourteen (14) days of notice to their original shoot time and date - The client is entitled to 1 shoot reschedule, at no extra shoot cost. If travel has already been expensed, the client will be required to pay the travel fees again on a new invoice (following the same fees/payment terms) to reschedule.
- Rescheduling with less than fourteen (14) days of notice for their original shoot time and date - The client will be required to pay both the travel fees (if already expensed) and the non-refundable retainer fee again on a new invoice (following the same fees/payment terms) to reschedule.
- Rescheduling with any amount of notice for a previously rescheduled shoot - The client will be required to pay both the travel fees (if already expensed) and the non-refundable retainer fee again on a new invoice (following the same fees/payment terms) to reschedule.
- If the Photographer wishes to reschedule either the Client's original or previously rescheduled shoot for any reason except due to bad weather, and the Client agrees to the reschedule, the Client is entitled to the shoot reschedule at no extra cost.
Cancelling
- If the Client wishes to cancel their original or rescheduled shoot before or on the shoot start time and date, they are entitled to a refund of all the original shoot's refundable costs.
- If the Photographer wishes to cancel the original or rescheduled shoot before or on the shoot start time and date, they will refund all fees to the Client, including any non-refundable retainer fees, and any non-expensed non-refundable travel expense fees. If the travel fees have already been expensed, they will remain non-refundable.
6. Weather
-
In the situation that, 2-3 days before the shoot, the Photographer believes
that there is bad weather forecast on the day of the shoot, and it will
affect the running of the shoot, the option will be given to the Client
to either:
- Reschedule the shoot at no additional shoot cost. If applicable, the client will be required to pay any travel fees again on a new invoice (following the same fees/payment terms) to reschedule.
- Cancel the shoot, and be subject to the Client cancellation terms.
- Proceed anyway, and see how the weather is last-minute. If this option is chosen, the Client understands and accepts the risk that the shoot could be rescheduled by the Photographer last minute, and the Client is subject to the below bad weather rescheduling terms.
-
If the Client opts to proceed anyway with the shoot after being given their
options for a bad weather risk 2-3 days prior, and the Photographer wishes
to reschedule the shoot on the shoot day due to bad weather:
- If the Client agrees to a reschedule, the Client understands they will be required to pay any travel fees again on a new invoice (following the same fees/payment terms) to reschedule.
- If the Client wishes to cancel the shoot instead of reschedule, they will be subject to the Client cancellation terms.
7. Copyright and Usage Rights
- The Client acknowledges that the Photographer is the sole author of the image(s). The image(s) and all copyrights remain the exclusive property of the Photographer, without limitation.
- Any Digital RAW files, Film Negatives or Film Positives remain the sole property of the Photographer, and will not be available to the Client.
-
The Photographer permits usage of the image(s) for personal and non-commercial
purposes only, with the following limitations:
- The Client will not make or permit alterations to any image(s), including, but not limited to: filters, additions, subtractions, or adaptations, without the prior express permission of the Photographer.
- If commerical usage of any image(s) is required, the Client must request a commercial use license from the Photographer before the image(s) are used for the commercial purpose. Note that this will come at an additional (and often considerable) cost.
- The Client grants permission to the Photographer to display and use the image(s) produced for the Client for any commercial or non-commercial purposes deemed appropriate by the Photographer.
8. Duty of Client
- The Client understands and agrees that the Photographer shall be the sole and exclusive photographer for the Client's shoot. The Client also understands and agrees that no party other than the Photographer may take photos of any lighting setups made by the Photographer.
9. Limitation of Liability
- The Client understands and agrees that they are responsible for obtaining all permissions, permits, tickets, or any other agreement necessary for the Photographer to photograph at the Client's shoot location(s). The Client understands and agrees that failure to obtain these permissions resulting in fines to the Photographer, or the Photographer being unable to conduct the shoot is not the fault, liability, or responsibility of the Photographer.
- The Client understands and agrees that they are responsible for the appropriate storing and backup of the image(s) delivered to them. The Photographer agrees to retain copies of the final image(s) from the shoot for a period of 1 year, but after this period has expired, the Photographer has no duty to retain these copies, and is not liable for any damages caused as a result of improper storage and backup of the image(s) delivered to the Client after this period.
- The Client understands and agrees that they are responsible for their own safety, and the Photographer is not liable for any injuries or physical damages caused that were not the direct effect of the Photographer's improper actions and/or improper usage of their equipment.
- The Client understands and agrees that if they sustain an injury or physical damages are caused at the shoot that were the direct effect of the Photographer's improper actions and/or improper usage of their equipment, the Photographer is limited to liability not exceeding the amount of the shoot, minus any expensed travel expenses.
- The Client understands and agrees that they are liable in the event the Photographer's equipment is lost, stolen, damaged, or destroyed as a direct or indirect effect of the Client's actions, not exceeding the cost of repair or purchase of a like-for-like replacement.
- The Client understands and agrees that the Photographer is not liable for any loss, damages or costs suffered by the Client or any third party, arising from the Client's usage of any image(s).
- In any other event, the Client understands and agrees that the Photographer's liability for all claims will not exceed the total amount of the shoot, minus any expensed travel expenses.
